TERMS OF SALES

Article 1 – Scope

The present general conditions of sale are intended to govern the relationship between INDRESS and its customers, adult natural persons acting exclusively for their personal use having the quality of consumer within the framework of the online sale of articles and products marketed by INDRESS via its site. www.indress.net .
By purchasing through the INDRESS website www.indress.net , the customer expressly and fully accepts these general conditions of sale.
These are subject to change and updates without prior notification. The conditions applicable to the order of an article by a customer are those in force on the day of the order.
In the event that one of the clauses of these general conditions of sale would be null and void by a change in legislation, regulation or by a court decision, this can in no way affect the validity and respect of these general conditions of sale or call into question the validity of the other provisions which will continue to apply.
The buyer acknowledges having had communication, prior to placing his order and concluding the contract, in a readable and understandable manner, of these general conditions of sale and of all the information listed in article L 221-5 of the French Code. consumption.

Article 2- Presentation of INDRESS
INDRESS is a LIMITED LIABILITY COMPANY with capital of €8,000, registered with the RCS of PARIS under number 440 973 212 and whose head office is located at 74 rue Charlot 75003.

Article 3 – Identification of articles
INDRESS cannot be held responsible for non-substantial errors that could affect the characteristics of the items presented on the www.indress.net website.
The photographs and other reproductions of the articles presented on the site www.indress.net are provided for information only and have no contractual value.

Article 4 – Order conditions
Order taking on the www.indress.net site is subject to strict compliance with the various stages of order registration. To place an order with INDRESS, the customer must have legal capacity and hold a Visa – Eurocard – Mastercard bank card or a PaylPal account.
INDRESS cannot be held liable for any damage inherent in the use of the Internet network (break in service, failure to connect to the Site, external intrusion, presence of computer viruses) or in the event of force majeure.

Article 5 – Availability of items
Orders are accepted within the limits of available stocks, of which the customer is informed at the time of his order, by a mention on the site itself or by customer service.

Article 6 – Acceptance of orders by INDRESS

INDRESS also reserves the right to refuse any order made by a customer with whom there is a dispute relating to the payment of a previous order.
In the event that the order does not meet these general conditions of sale, the customer will be informed by INDRESS within a maximum period of six (6) days by telephone or e-mail.
If the customer fails to bring his order into conformity with INDRESS, INDRESS reserves the right to purely and simply cancel the said order.

Article 7 – Agreement of proof
The e-mails will prevail between the parties as well as the automatic recordings used by INDRESS, in particular as to the nature and the date of the order.

Article 8 – Price of items
The prices displayed on the www.indress.net website are indicated in Euros and include all taxes included (TTC), excluding delivery costs. The prices invoiced are those in effect on the date of the order.
The amount of the transport costs relating to the delivery of the articles will be automatically displayed in the basket during the validation of the order by the customer. The customer will receive, upon delivery, for each of the items, written confirmation of the price paid and the delivery costs charged to him.
In the context of an order to a country outside the European Union, the customer remains the importer (or intra-community purchaser) of the item(s) concerned. As such, customs duties, local taxes, import duties, or state taxes that may be required are the responsibility of the customer.

Article 9 – Terms of payment
The payment of orders is made by PayPal or with all the cards of the "CB" network, Visa, Eurocard, Mastercard, American Express and other bank cards accepted by PayPal depending on the country of purchase.
Cards issued by banks domiciled outside France must be international bank cards.
The customer also agrees to make payment via a bank card which he personally holds and bearing his identity (surname and first name).
By communicating his bank card number and/or his bank details, the customer accepts in advance and unconditionally that INDRESS proceeds with the secure transaction.
The customer therefore authorizes his bank in advance to debit his account in view of the records or statements transmitted by INDRESS, even in the absence of invoices signed by the hand of the cardholder.
The authorization to debit the customer's account is always given for the amount of the item(s) purchased as invoiced by INDRESS.
The customer's bank card is debited within a maximum of six (6) days after verification of the satisfaction of the order with these general conditions of sale, of the availability of the item(s).
In the event that, for any reason whatsoever (objection, refusal of the issuing centre, etc.), the debit of the sums owed by the customer proves impossible, the order will not be recorded by INDRESS.

Article 10 – Security of transactions
INDRESS uses the PayPal payment system, a secure online payment system that encrypts data and payment information. INDRESS does not store any credit card numbers.
INDRESS has chosen BNP and its secure payment interface as its partner. When paying, the customer will be automatically directed to the BNP payment platform. The customer can then securely transmit his bank details since the data is encrypted by the “Secure Socket Layer” security system (SSL technology).

Article 11 – Delivery
The shipping of items by the company INDRESS will only occur after receipt of payment for the order.
Orders are shipped by DHL, MondialRelay, Courier or by LA POSTE in the COLISSIMO service to the delivery address indicated by the customer.

As an indication, the delivery times are as follows:

– DHL: 2-3 working days.

– MondialRelay: 4-6 working days.

– Coursier.fr (Paris): 1 working day.

– La Poste/Colissimo (Metropolitan France): 4-6 working days.

– INDRESS store; 1 working day.

These deadlines are given for information only and depend on the carrier chosen when ordering, INDRESS cannot be held responsible in the event of late delivery. The delivery is made against signature of the customer.
Any unsuccessful delivery (address, building, code, staircase, missing or incorrect name, etc.) will be subject to additional time for processing the order, and for reshipping.
The shipping costs are calculated automatically according to the place of delivery of the weight and the total volume of the items ordered, so as to ensure the fairest possible cost.

Between December 23 and January 4 and from August 7 to August 25, INDRESS closes for the holidays, as does the Eshop. Orders placed during this period will be subject to a longer delay.

Shipping cost
The amount of the delivery costs, payable by the buyer when the basket is less than 500 Euros in France, 800€ Europe and 1000 euros outside Europe, is indicated in the shopping basket, after you have informed and validated the delivery adress. The shipping costs are calculated automatically according to the place of delivery of the weight and the total volume of the items ordered, so as to ensure the fairest possible cost.

Customs duties
In the event of delivery outside Europe, the customer is required to proceed to the authorities of his territory to pay any tax or fee (customs duties, local taxes, etc.) imposed by the regulations.

Article 12 – Personal data
When taking an order INDRESS collects personal data, this data is necessary for the processing of the order and may be communicated in whole or in part to the contractual partners of the Company acting strictly within the framework of the execution of the order.
The customer is informed that these same personal data are also collected by the organization in charge of managing orders and payments as well as the fight against credit card fraud.
The user is informed that this automated processing of information has been declared to the CNIL under number 1453752 dated 09/22/10.
In accordance with the Data Protection Act of January 6, 1978, the customer has a right to access, modify, rectify, oppose and delete personal data concerning him.

Article 13 – Right of withdrawal and return of items
In accordance with the provisions of the Consumer Code, the customer has a right of withdrawal which he can exercise, without having to justify reasons, within fourteen (14) working days from the date of receipt of the articles. . However, for obvious hygiene reasons, we cannot accept the return of masks purchased on our Eshop.
To notify their desire to return or exchange one or more items, the customer may, within fourteen (14) days, contact customer service by e-mail at: boutique@indress.net . By mentioning his order reference, the date and the item(s) he wishes to return or exchange (size/color).

In this context, the customer has the option of returning the items delivered within this period, in their original packaging, in perfect condition, complete and accompanied by a copy of the invoice addressed to INDRESS 74 rue Charlot 75003 Paris France.
The return costs remain in all cases the responsibility of the customer. The responsibility for the return belongs to you until the package reaches us. Don't forget to ask for proof of postage and your tracking number. To ensure that the package reaches us safely, we recommend that you use an international delivery service provider such as UPS/DHL/Fedex/TNT…

Reimbursement of the invoiced price of the returned items will be made by the same means as that of the order (transfer or PayPal) at the latest within thirty days following receipt, by INDRESS, of the returned items. Any item that cannot be released for consumption as received cannot be refunded.

Any return that has not been notified in advance to customer service cannot be accepted.

Article 14 – Guarantee of conformity
The items sold online by INDRESS are subject to the conditions of legal guarantees provided for by articles L 217-4 and following of the Consumer Code as well as by articles 1641 and following of the Civil Code:
In the event of implementation of the legal guarantee of conformity, it is recalled that:
– The buyer has a period of 2 years from the delivery of the property to act.
– The buyer can choose between repairing or replacing the goods, subject to the cost conditions provided for in article L 217-17 of the consumer code.
– The buyer is exempted from providing proof of the existence of the lack of conformity of the goods for 24 months following delivery of the goods.

Article 15 – Complaints
For any information, complaint or question relating to the distance selling conditions put in place by INDRESS, the customer must contact customer service by post at the following address: INDRESS 74 rue Charlot 75003 Paris – France or by e -mail: boutique@indress.net , recalling in both cases the reference and the date of the order.
As this is an Internet sale, no complaint of any kind can be processed in store. Only complaints concerning purchases made on the INDRESS online store will be taken into account.

Article 16 – Intellectual Property Rights
This website remains the exclusive property of the INDRESS Company, which has created and put online the web pages, images and script sources, the basic data composing it.
The customer is therefore prohibited from distributing or reproducing or creating a link with the website, in whole or in part, in any form whatsoever, under pain of being guilty of an offense of counterfeiting.

Article 17 – Force majeure
The performance by INDRESS of all or part of its obligations will be suspended in the event of the occurrence of a fortuitous event or force majeure which would hinder or delay its performance.
INDRESS will inform the customer of such fortuitous event or force majeure within seven days of its occurrence. In the event that this suspension continues beyond a period of fifteen (14) days, the customer would then have the possibility of terminating the current order.

Article 18 – Mediation
If you have a problem with a product, our site or any other INDRESS company service related to the site or a product, please contact our customer service department at boutique@indress.net .

In the event that your problem is not resolved, in accordance with the provisions of the consumer code concerning “the process of mediation of consumer disputes”, you have the right to use a mediation service free of charge.

INDRESS has signed a framework agreement with the MC2C mediation body which allows it to arbitrate disputes out of court. This mediation body can be contacted via its website www.cm2c.net

Article 19 – Disputes – Law
These general conditions of sale are subject to French law. In the event of a dispute, only the version of the general conditions of sale written in French will prevail between the parties. Any dispute that may arise from the interpretation or execution of these general conditions of sale and its consequences will be subject to the exclusive jurisdiction of the French courts.
